MA Motor Vehicle Homicide Law

To prove motor vehicle homicide the prosecutor needs to prove that the defendant recklessly operated a motor vehicle, under the influence, on a public way and a death occurred.  To prove that the defendant operated recklessly, the prosecutor needs to prove that the defendant’s intentional conduct involved a high degree of likelihood that substantial harm would result to another.  It doesn’t matter if the defendant did not intend to harm anyone.

MA Motor Vehicle Homicide Penalties

An offender can face up to 15 years in state prison.  The offender must serve at least 1 year of that sentence, which cannot be reduced by parole or good time.  The offender will lose his license for at least 15 year and can be suspended for life.
