DUI Operators Under 18 years old Law
In MA, if you are under the age of 18 you can face additional suspension for refusing the take the breathalyzer. Or you failed the breathalyzer by having a blood alcohol level of .02 or above. It doesn’t matter if you are a junior operator or not.
The penalty for a person under 18 for refusing or failing the breathalyzer is a license suspension of 1 year. This 1 year license suspension for being under 18 is in addition to the amount of time that your license will be suspended for refusing a breathalyzer or failure.
License suspension for DUI Operator Under 18 who refuse the breathalyzer
- No prior DUI: 3 years + 1 year
- 1 prior DUI: 3 years + 1 year
- 2 prior DUI: 5 years + 1 year
- 3 or more DUI: Lifetime + 1 year
The additional 1 year license suspension may be reduced by the MA registry if you enroll into an approved program. The point of the additional license suspension is to encourage you to undergo an alcohol education program.
MA DUI Operator Under 18 Failing Breathalyzer
In MA, if breathalyzer reading of .02 or higher and you are under the age of 18, your license will be suspended for 30 days + 1 year. The 1 year license suspension may be reduced to 180 days if you enter into an approved alcohol education program.
