Compliance Hearing

If your case is not resolved at the pre trial conference hearing the next date is usually the compliance hearing.  Any discovery requested by your attorney is usually produced by the prosecutor during the compliance hearing.  Depending on the court and the judge the prosecutor may produce the discovery 4 weeks prior to trial.  The compliance hearing is not a mandatory date that you must schedule, however it can be a useful stage for your criminal case.

Aside from your attorney getting the discovery at the compliance hearing, your attorney may also be able to learn more about your case from the prosecutor.  Many times in criminal cases, the prosecutor will have ongoing conversations with witnesses and alleged victims during the criminal process.  By the time the compliance hearing comes your attorney may learn critical information that will help you make strategic decisions.

Finally, you may also resolve your case during the compliance hearing.  If you cannot resolve your case during the hearing, then the case is usually scheduled for a motion or a trial.
