Being charged with distributing drug charge in Massachusetts is very serious. If the defendant is charged with a school zone violation, the defendant is exposed to a two year minimum mandatory jail sentence. Under Massachusetts General Law Chapter 94 C, section 32, in order for the state to prove that a defendant distributed drugs, the prosecutor must prove that the defendant intentionally manufactured, distributed, dispensed, possessed with intent to manufacture, distribute, or dispense a controlled substance.
Massachusetts Drug Distribution Penalties
If convicted of drub distribution the defendant could face up to 10 years in state prison, or 2 ½ years in jail, and or a fine up to $10,000. If the defendant is charged with a second and subsequent offense, the defendant is exposed to a mandatory minimum of 5 years in state prison and up to a $25,000 fine. If convicted of a subsequent offense, the defendant cannot pay a fine to avoid the 5 year mandatory minimum jail sentence. The penalties depend on the defendant’s record.
