Having drugs in your possession is seen as a serious offense.  It is much better to be charged with possessing a controlled substance under Massachusetts General Law Chapter 94 C, section 34 than distributing drugs.  In order for the state to prove that a defendant possessed drugs, the prosecutor must prove that the defendant intentionally possessed a controlled substance beyond a reasonable doubt.

Massachusetts Possession of Drug Penalties

The penalties of drug possession are dependent on the type of drug the defendant is charged.  For the possession of heroin, a person could face jail time up to 2 years, a fine of not more than $5000 or probation.  A conviction of heroin or cocaine will lead to the defendant’s right to operate a motor vehicle to be suspended by the registry.
