Carjacking is a very serious felony in Massachusetts.  To prove a defendant guilty of this carjacking, the prosecution needs to prove that the defendant intended to steal a car, assaults, confine, maims or puts a person in fear for the purpose of stealing the car.  For this crime, it does not matter if the suspect is successful in stealing the car.

Massachusetts Carjacking Penalties

If the defendant is found guilty of carjacking, the defendant can face up to 15 years in state prison or not more than 2 ½ years in jail.  The defendant could also face a fine of not less than $1,000 or not more than $15,000.  If the defendant was armed with a dangerous weapon during the carjacking, the defendant must serve at least one year and can face up to 20 years prison.  If armed with a firearm during the carjacking, the defendant must serve at least 5 years in state prison.
