Massachusetts Kidnapping Issues

Kidnapping is a serious felony in the state of Massachusetts.  Aside from being charged with kidnapping, the defendant is usually facing other serious felony charges.  A defendant could face kidnapping charges in Superior Court or even Federal Court if state lines are crossed.

Massachusetts Kidnapping Laws

The prosecution can convict a defendant of kidnapping through two ways.  First, the prosecution could prove that the defendant forcibly or secretly confines or imprisons another person within the commonwealth against is will, or forcibly carries or sends such person out of the commonwealth.

The second way to prove kidnapping, is the prosecution could prove that the defendant forcibly seizes and confines or kidnaps another person with intent, either to cause him to be secretly confined or imprisoned in this commonwealth against his will, or to cause him to be sent out of this commonwealth against his will or in any way held to service.

Massachusetts Kidnapping Penalties

If the defendant is convicted of kidnapping, he could face up to 10 years in state prison, up to a $1,000 fine, or up to 2 years in the house of corrections.  If the kidnapping was done in exchange to extort money or other things of value, the defendant could face up to life in prison.  If the defendant is armed with a firearm while kidnapping, the defendant must serve at least 10 years in state prison.

If the defendant was armed with a firearm and had the intent to extort money, then the defendant must serve at least 20 years in state prison.  If the defendant is armed with a dangerous weapon and inflicts serious bodily injury or sexually assaults, the defendant must serve at least 25 years in state prison.
