Rape is a very serious crime.  In order for the prosecution to prove the defendant guilty of a rape charge, the prosecution needs to prove several things.  The prosecution would need to prove that the defendant had sexual intercourse with a person.  That the defendant compelled the victim to submit by force and against his or her will, or compels the victim by threat or bodily injury.

And that such sexual intercourse results in serious bodily injury, or is committed by a joint enterprise, or is committed during the commission of certain charges.  Some of these charges are assault and battery, assault with dangerous weapon, armed robbery, unarmed robbery, kidnapping, burglary, breaking and entering, or carrying a dangerous weapon.

Massachusetts Rape Penalties

If the defendant is convicted of rape, the defendant can be sentenced up to life in prison.  If the defendant was armed with a firearm and the rape is a first offense, the defendant must serve at least 10 years in state prison.  If the defendant is armed with a firearm and it is a second or subsequent offense, the defendant must serve at least 15 years in state prison.
